Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ModernTechLap platform, website, APIs, and all related services (collectively, the “Service”) provided by ModernTechLap (“ModernTechLap”, “we”, “our”, “us”).

By creating an account, accessing, or using the Service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service.

You must be at least 16 years old and legally capable of entering a binding contract in your jurisdiction to use the Service. By accepting these Terms, you represent that you meet these requirements. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

• You must provide accurate, complete, and current information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately at admin@moderntechlap.com of any unauthorised account access.
• You are responsible for all activity that occurs under your account.
• You may not share your account credentials with any third party or create accounts on behalf of others without their consent.

You agree not to use the Service to:

• Distribute illegal, fraudulent, defamatory, obscene, or harmful content.
• Infringe any intellectual property rights of any third party.
• Transmit spam, unsolicited messages, or deceptive advertising.
• Scrape, crawl, or extract data from the Service without written permission.
• Attempt to bypass, disable, or interfere with security features.
• Use the Service in any way that violates applicable laws or regulations.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use automated scripts or bots to interact with the Service.

5.1 Your Content

You retain ownership of all content you submit to the Service (“Your Content”). By submitting content, you grant ModernTechLap a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, and distribute Your Content solely for the purpose of providing the Service.

You represent and warrant that you own or have the rights to all content you submit, and that Your Content does not violate any third-party rights or applicable laws.

5.2 ModernTechLap Intellectual Property

All intellectual property rights in the Service, including software, algorithms, documentation, and trademarks, belong exclusively to ModernTechLap or its licensors. Nothing in these Terms grants you any rights in the Service beyond the limited licence to use it as described herein.

6.1 Creating an Account

Creating an account is free and does not require a payment method. You only pay when you choose to purchase publishing credits or a Paid PR package.

6.2 What You Are Buying

Publishing is sold as one-off packages, not as a subscription. A package entitles you to a stated number of published posts. Current pricing is available at moderntechlap.com/pricing, and packages negotiated directly with us are set out in writing at the time of sale. All prices are quoted in USD and are exclusive of any applicable taxes.

6.3 No Recurring Charges

There is no subscription, no billing cycle, and no automatic renewal. We do not store your card details, and we will never charge you again without you making a new purchase. Payments are taken at the time of purchase by our payment provider.

6.4 Refunds

If we refund a purchase in whole or in part, a corresponding number of unused publishing credits is removed from your account. Where credits have already been used to publish, the refund may leave your balance negative, and further publishing is unavailable until the balance is settled. Posts already published are not automatically removed by a refund.

6.5 Failed or Incomplete Payments

Credits are added only once payment is confirmed by our payment provider. If a payment is not completed, no credits are granted and nothing is owed by you.

Purchased credits are added to your account balance and are consumed one credit per post when a post is submitted for review or published. Credits do not expire and are not transferable between accounts. Opening or editing a draft does not consume a credit, and a post returned to you for changes and resubmitted is only charged once.

Any allowance included with a free account is separate from purchased credits, applies for the period stated on your account, and is used before purchased credits are drawn down.

8.1 By You

You may terminate your account at any time by contacting us at admin@moderntechlap.com or through your account settings. Termination does not entitle you to a refund for unused publishing credits.

8.2 By ModernTechLap

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. MODERNTECHLAP DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MODERNTECHLAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. IN NO EVENT SHALL MODERNTECHLAP'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MODERNTECHLAP IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.

You agree to defend, indemnify, and hold harmless ModernTechLap, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms.

These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved by binding arbitration conducted remotely, or at a venue the parties agree in writing, except that either party may seek injunctive relief in any court of competent jurisdiction for IP infringement or data protection violations.

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a prominent notice on the Service. Your continued use after the effective date constitutes acceptance of the updated Terms.
